1.   Introduction

We at Season Three Inc. (collectively, “Season Three", "we", "us", or "our”), know you care about how your personally identifiable information is used and shared, and we take your privacy very seriously. Please read the following to learn more about our Privacy Policy (the “Policy”). This Policy applies to information we collect when you access or use our technology platforms (including, without limitation, our websites, mobile applications and other Season Three controlled properties that link to this Policy) (collectively, the "Platforms"), engage with us via social media, or when you otherwise interact with us. By providing us with your Personal Information (as defined below) or otherwise interacting with us, you consent to the collection, use and disclosure of that information in accordance with this Policy. We may supply different or additional notices of our information practices specific to certain programs or activities. Capitalized terms not defined here are defined in Season Three’s Terms of Service, which are available here.

2. Information Collected

 "Personal Information" is information that may be used to identify you as an individual. When you use the Platforms, you will have the opportunity to provide us with some information directly. For example, some functions of the Platforms allow you to register for an account, where we may ask you for your email address and preferred username. As another example, we may also collect other information you directly give us as you build your profile on the Platforms, such as your name, demographic information, and phone number.

 We may collect Personal Information when you interact with Season Three, such as when you:

  • Visit or register through our Platforms;
  • Purchase, return or reserve merchandise through one of our Platforms;
  • Consent to receive our promotional email;
  • Contact or visit our Customer Service Department, or otherwise contact us or one of our service providers with a comment, question or complaint.

We also collect certain information through our Platforms automatically, such as:

  • Usage Information. Whenever you visit or interact with our Platforms, we, as well as our vendors and/or service providers (collectively, "Vendors"), may use a variety of technologies that automatically or passively collect information ("Automated Technologies") about how the Platforms are navigated, accessed and used ("Usage Information"). Usage Information may include browser type, device type and characteristics, Device Identifiers (as defined below), operating system, application version, the pages served, the time/date, your geo-location, the preceding page views, and your use of and pathway through the Platforms.
  • Device Identifier. We or our Vendors may automatically collect your IP address(es) or other unique identifiers ("Device Identifier") for the "Device" (e.g., computer, mobile phone, tablet or other device) you use to access the Platforms. A Device Identifier is usually a number that is assigned to your Device when you access a Platform or its servers, permitting identification of your Device.
  • Automated Technologies. The Automated Technologies used on the Platforms to collect Usage Information include, but are not limited to, cookies (data files placed on a Device when it is used to visit the Platforms), mobile analytics software, pixel tags (a transparent graphic image, sometimes called a web beacon or tracking beacon, placed on a Platform to indicate that a page or email has been viewed), and similar technologies. Both session cookies (which expire once you close your web browser) and persistent cookies (which remain on your Device, sometimes until you delete them) may be used. Please remember, some Automated Technologies may tell your browser to get third party content, such as customer reviews, from another server.

Our Advertisers (defined below) may also transmit cookies to your browser or device, when you click on ads that appear on the Platforms. If you click on a link to a third party website or service, a third party may also transmit cookies to you. Again, this Policy does not cover the use of cookies by any third parties, and we aren’t responsible for their privacy policies and practices. Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Platforms, and those third parties may not honor “Do Not Track” requests you have set using your browser or device.

If you would prefer not to accept cookies, most browsers will allow you to: (i) change your Device browser settings to notify you when your Device receives a cookie, which lets you choose whether or not to accept it; or (ii) set your Device browser to automatically reject any cookie. Removing or rejecting browser cookies does not necessarily affect third party flash cookies used in connection with our Platforms. However, please be aware that if you disable or reject cookies, some features and services on our Platforms may not work properly, because we may not be able to recognize and associate you with your Season Three account. Please note, even if you choose to restrict or modify your settings, you may still see or receive Season Three advertisements via our Platforms and on other sites, but those advertisements will not be based upon your browsing history. 

We collect this information automatically through our Platforms for security purposes (including protecting the integrity of the Platforms and our stores), to better understand and enhance user navigation on our Platforms, and for marketing and analytics purposes (including allowing the selection of personalized ads or offers believed to appeal to you, based on your interests, preferences, location, or demographic information). Additionally, Automated Technologies may be used to associate you with social networking sites (e.g., Facebook, Twitter and Snapchat), and, if you so choose, enable interaction between your activities on the Platforms and your activities on those social networking sites.

In certain circumstances, we may also collect Personal Information that you provide to us about other people. For example, you may provide us with the name and address for a gift recipient. When you provide us with this Personal Information, we use it for the purposes of processing the shipment and, in some cases, to communicate with the intended recipient. We rely on you to obtain any necessary consent from the intended recipient to our use of their Personal Information for these purposes.

Certain parts of the Platforms allow you to upload or post User Content, which means information posted by the user on the Platform. You may post User Content at your sole discretion, but please note that any User Content you post may be publicly available, viewable to others, and may appear in search results of third-party search engines. Season Three recommends that you do not post any sensitive Personal Information, such as your name, address, information about website accounts, credit card numbers, or your Social Security Number, because that information may be seen by others.

3.   Use of Collected Information 

If you choose to visit and register with one of our Platforms, we will collect the registration information that you provide, such as your contact and account-related information for the purposes of administering and securing your account on our Platforms.

When you purchase or return merchandise through one of our Platforms, we collect and use the Personal Information that you provide, such as your order, contact, and shipping information for the purposes of fulfilling your order, processing your return, and updating you on the status of your order/return. In order to use our Platforms, you will be asked to provide certain financial information so that you can be charged for the merchandise that you have purchased. Please note that your financial information will be collected by a third party payment processor that we have engaged to handle our financial transactions, and we will not have access to your financial information.

When you consent to receive information from us, such as promotional emails or other information, we collect and use your contact information for the purposes of fulfilling your request. You can unsubscribe from promotional communications by following the instructions in the message. If you have any questions about unsubscribing from our messages, please contact us as outlined below.

We collect the Personal Information that you provide if you choose to participate in one of our contests, sweepstakes, promotions, surveys or other customer research, for the purposes of administering them. We will also use the Personal Information you provide to analyze and better understand how customers interact with our brands.

4.   Disclosure of Information

We use the Personal Information you provide to us when you contact our Customer Service Department for the purposes of reviewing any issues you raise and responding to you. Depending upon the nature of your query, we may request additional Personal Information for the purposes of verifying your identity.

We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. For example, we may use a payment processing company to receive and process your credit card transactions for us. Unless we tell you differently, our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us.

We may obtain information from other sources and combine that with information we collect directly from you. For example, we may collect information from third parties to ensure that we have up-to-date contact information for you, to detect fraud or theft, to facilitate your use of a third-party application or feature (such as one of our Facebook, Twitter or Snapchat applications or similar applications or features on a third-party website), or from third-party analytics and advertising providers as further described below.

If we combine any information about you received from third parties with your Personal Information or other information collected pursuant to this Policy, then we apply the applicable provisions of this Policy to the combined information, so long as it is combined.

If you choose to enroll or engage in one of our optional loyalty programs, we will use the Personal Information you provide to us, along with information about the products and services you purchase from Season Three, for the purposes of administering the loyalty program, including any points you earn or redeem through the programs.

Please note that if you submit any of your Personal Information to a portion of the Platforms that is accessible by other users, including an online forum or comment section, other users will be able to see that Personal Information. Accordingly, only include information in your submissions that you are comfortable sharing with third parties.

We allow advertisers and/or merchant partners (“Advertisers”) to choose the demographic information of users who will see their advertisements and/or promotional offers and you agree that we may provide any of the information we have collected from you in non-personally identifiable form to an Advertiser, in order for that Advertiser to select the appropriate audience for those advertisements and/or offers. For example, we might use the fact you are located in Boston to show you ads or offers for Boston businesses, but we will not tell those businesses who you are. Or, we might allow Advertisers to display their ads to users with similar usage patterns to yours, but we will not disclose usage information to Advertisers except in aggregate form, and not in a manner that would identify you personally. Note that if an advertiser asks us to show an ad to a certain audience or audience segment and you respond to that ad, the advertiser may conclude that you fit the description of the audience they were trying to reach.

We may de-identify your Personal Information so that you are not identified as an individual, and provide that information to our partners. We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use the information to understand how often and in what ways people use our Platforms, so that they, too, can provide you with an optimal online experience. However, we never disclose aggregate usage or de-identified information to a partner (or allow a partner to collect that information) in a manner that would identify you as an individual person.

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Information to third parties for the third parties’ direct marketing purposes; in order to submit such a request, please contact us at info@seasonthree.com.

We may choose to buy or sell assets, and may share and/or transfer customer information in connection with the evaluation of and entry into those transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with law or court order; enforce or apply our Terms of Service and other agreements; or protect the rights, property, or safety of Season Three, our employees, our users, or others.

5.   Security Disclaimer

We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but unfortunately, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time. 

6.   Modification Deletion

Through your account settings, you may access, and, in some cases, edit or delete the following information you’ve provided to us: 

  • name and password
  • email address
  • location
  • user profile information, including images and videos you have uploaded to the site

The information you can view, update, and delete may change as the Platforms change. If you have any questions about viewing or updating information we have on file about you, please contact us at help@seasonthree.com. 

Finally, if you request, we will remove your name and all other Personal Information that you have provided from the Platforms. Please understand, however, that it may be impossible to delete this information completely, due to backups and records of deletions. In addition, please understand that, if you request removal of your information, you will be unable to utilize associated features of the Platforms. You may not request the removal of de-identified, anonymous, or aggregate data from our databases. 

7.   Age of Users

Our Platforms are not directed toward children under the age of thirteen (13) years. Furthermore, we do not knowingly collect any personal data from children under the age of thirteen (13) years. If we ever offer children's products for sale on our Platforms, they are only intended for purchase by adults. No one under the age of thirteen (13) years should provide any personal data on our Platforms.

8.   Changes to Policy

Season Three reserves the right, at its sole discretion, to modify this Policy at any time and without prior notice. If we modify this Policy, we will either post a notification of the modification on our website or otherwise provide you with notice of the change. The date of the last modification will also be posted at the beginning of this Policy. It is your responsibility to check from time to time for updates. By continuing to access or use the Platforms, you are indicating that you agree to be bound by any modified Policy.
